Terms of Use

These Terms of Use (“Terms”) are an agreement between you and S S Niranjan, an individual based in Chennai, India (“we”, “us”), the publisher of the Sip Pup app (“Sip Pup” or “the app”). Sip Pup is currently available on Android through Google Play. An iPhone version is planned but not yet available. Where these Terms mention Apple or the App Store, those parts apply if and when Sip Pup is available on the Apple App Store. By creating an account or using the app, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use Sip Pup.

1. Who can use Sip Pup

Sip Pup is designed for adults. You must be at least 18 years old to create an account, and you confirm this by ticking “I confirm I'm 18 or older” when you sign up. You're responsible for keeping access to your email address secure, since that's how you sign in.

2. Your licence to use the app

We give you a personal, non-exclusive, non-transferable, revocable licence to download and use Sip Pup on devices you own or control, for your own non-commercial use, in line with these Terms and the rules of the store you got it from. You may not copy, modify, sell, rent, reverse-engineer or redistribute the app, its animal characters or its content, except where the law allows this despite these Terms. We (and our licensors) keep all rights not expressly given to you.

3. Your account

You sign in with your email address and a one-time code. One account is for one person. Your water logs and settings belong to you; you give us permission to store and process them only to provide Sip Pup to you, as described in the Privacy Policy.

4. The 7-day free trial

• Each new account gets a 7-day free trial with full access. No payment method is needed, and you won't be charged at the end of the trial unless you choose to subscribe.
• The trial is timed by our server's clock. When it ends, reminders stop and the app asks you to subscribe to continue. Your data and earned animals are kept.
• The free trial is limited to one per person and per device. We may decline a trial for a new account on a device that has already had one.

5. Subscriptions

From time to time we may offer introductory or promotional prices, such as a lower price for your first few months. The offer price, how long it lasts, and the regular price that applies afterwards are always shown before you confirm your purchase.

• Prices in other countries are set by the store in local currency and may include taxes. The price you'll pay is always shown before you confirm.
• Payment is charged to your Apple ID or Google Play account when you confirm the purchase.
• Subscriptions renew automatically at the end of each period at the same price, unless you cancel at least 24 hours before the end of the current period.
• You can manage or cancel your subscription at any time in your App Store or Google Play account settings (also reachable from Settings → Manage Subscription in the app). Cancelling stops the next renewal; you keep access until the end of the period you've paid for.
• Deleting your account or the app does not cancel a subscription. Please cancel it in your store settings.
• Refunds: Except where required by Google Play, Apple, or applicable law, purchases are non-refundable. Any refund request is subject to the applicable store's policies, and we can't issue refunds for store purchases ourselves.
• If we change subscription prices, the store will notify you in advance, and where required you'll be asked to agree before the new price applies.
• You can restore your purchases on a new device with Restore Purchases while signed in to the same store account.

6. One-time purchases

From time to time we may offer optional one-time purchases, such as special seasonal animals, for a limited period. They're charged once through your store account, aren't subscriptions, and can be restored on a new device. The animals you earn through regular use are never sold. The refund terms in section 5 also apply to one-time purchases.

7. Health information

Reminders are delivered by your phone and can be delayed or blocked by battery, Focus, Do Not Disturb or notification settings, so please don't rely on them for anything critical.

8. Acceptable use

Don't misuse Sip Pup: don't try to access other people's data, interfere with or overload our systems, get around the free-trial or subscription rules, create accounts in bulk, or use the app for anything unlawful. We may suspend or close accounts that do.

9. Changes and availability

We may update, change or discontinue features to improve Sip Pup. We'll try to keep the app available but can't promise it will always be uninterrupted or error-free. If we ever discontinue a subscription, we'll stop renewals.

10. Ending your use

You can stop using Sip Pup at any time and delete your account in Settings → Delete Account. We may end or suspend your access if you seriously or repeatedly break these Terms. Sections that by their nature should survive (such as 7, 11, 12 and 13) continue after your use ends.

11. Disclaimers and limitation of liability

To the extent the law allows, Sip Pup is provided “as is” and “as available”, without warranties of any kind. To the extent the law allows, we aren't liable for indirect, incidental or consequential losses, and our total liability to you for any claim relating to Sip Pup is limited to the amount you paid us for Sip Pup in the 12 months before the claim. Nothing in these Terms limits any rights you have under consumer protection law that can't be limited.

12. Governing law and disputes

These Terms are governed by the laws of India. Subject to any non-waivable rights you have under consumer protection law, the courts at Chennai, Tamil Nadu have exclusive jurisdiction over any dispute relating to these Terms or Sip Pup. Please contact us first; most concerns can be resolved quickly.

13. App Store terms

This section applies if and when Sip Pup is available on the Apple App Store and you downloaded it from there:

• These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for Sip Pup and its content.
• Apple has no obligation to provide maintenance or support for Sip Pup.
• If Sip Pup fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the extent the law allows, Apple has no other warranty obligation for Sip Pup.
• We, not Apple, are responsible for addressing any claims relating to Sip Pup, including product liability, failure to meet legal or regulatory requirements, and consumer protection or privacy claims.
• We, not Apple, are responsible for investigating and resolving any claim that Sip Pup infringes someone's intellectual property rights.
• You confirm you're not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and you're not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

If you downloaded Sip Pup from Google Play, Google Play's terms also apply to your use of the store and payments.

14. Changes to these Terms

If we make material changes, we'll update the effective date and tell you in the app or by email before they take effect. If you keep using Sip Pup after that, you accept the updated Terms.
